Privacy policy
(1) below we inform you about the nature, scope and purpose of processing your personal data when using our Etsy shop. Personal data are all information relating to an identified or identifiable natural person.
(2) The person responsible for the purposes of the EU Data Protection basic Regulation (DSGVO) is the natural or legal entity who, alone or together with others, decides on the purpose and means of processing personal data. Personal data processed by the provider of this Etsy shop is responsible in the sense of the DSGVO: Hartmut Gambke, Paulinenstr. 9, 12205 Berlin, phone 030 8333818, e-mail hgambke@t-online.de (hereinafter "we"). (3) When you complete a contract with us through Etsy, Etsy will send us your Etsy username (if you do not purchase it as a "guest"), your name and billing address as stored in your Etsy user account. You have given them in the course of concluding the contract. If you specify further data in the course of your order (e.g. a different delivery address or a telephone number), these will also be transmitted to us.
(4) We process the data referred to in paragraph 3 electronically for the proper performance of the contract, in particular for the delivery, invoicing, posting of payments and processing of returns and complaints. This data will be processed on the basis of article 6 (1) (b) DSGVO. We keep this data until all mutual claims from the respective contractual relationship with you have been completely settled and the trading and tax retention periods that we are subject to have expired.
(5) In order to conclude a contract between you and us it is necessary that we receive your name and a delivery address. The necessity for the provision of this data results, among other things, from the terms and conditions of Etsy as well as from legal regulations (e.g. § 312i para. 1 clause 3 BGB, § 14 para 4 UStG). Therefore, you will not be able to conclude a contract with us without providing this information.
(6) As far as we send you physical goods on the basis of the purchase agreement, we may transmit your name and your shipping address to Deutsche Post (Deutsche Post AG, 53113 Bonn) or DHL (DHL Parcel GmbH, 53113 Bonn) as a shipping service provider for the purpose of Delivery of the consignment to you and, if necessary, the return of your shipment to us on the basis of article 6 (1) (b) DSGVO.
(7) for the payment of a purchase, the payment service provider you have chosen collects and processes your name, card or account number and/or other data required for the respective payment method on your behalf. This applies to the privacy policy of the chosen payment service provider and, if the recipient of the payment is Etsy, the Etsy privacy statement.
(8) If you send us a message about "Ask a question", "Ask a special production" or a similar function on the Etsy platform, Etsy will forward your Etsy username or, if you do not have an Etsy username, a miscellaneous Sender identification along with your message (legal basis: Article 6 (1) (a) DSGVO). If you send us a message by e-mail, we will store your message with the sender's data (name, e-mail address) in order to answer it and also to respond to any subsequent questions you may have (legal basis: Article 6 (1) (f) DSGVO). In order to receive, store and send e-mails, we use an e-mail provider that operates for us as a processor in accordance with article 28 DSGVO. We will delete the data collected with your message no later than six months after the last communication with you to your request, subject to the adjustment in the following paragraph.
(9) If you provide us with a legally relevant declaration on the contractual relationship (e.g. a revocation or a complaint), the legal basis for the processing, irrespective of the means, is also article 6 (1) (b) DSGVO. In such a case, we delete the data related to your declaration, as soon as all reciprocal claims from the contractual relationship are finally settled and the trading and tax retention periods have expired.
(10) Social media buttons can be displayed on the pages of Etsy; They are visible on the logos of the social media platforms (hereinafter "platforms") (Facebook: Blue "F", Pinterest: Red "P", Twitter: Blue Bird silhouette). These are links to the respective platforms based in the USA. A click on such a link calls up the Web page of the respective platform, whereby the IP address of the calling terminal and the address of the page from which is linked ("referrer") are transmitted to the called Platform to the USA. However, no data is collected or processed by us in connection with the social media buttons.
(11) We do without automated decision-making and profiling.
(12) Regarding the personal data we process about you, you have the following rights:
A) You have the right to ask us to confirm whether we are processing personal data concerning you. If this is the case, we shall inform you of the personal data stored about you and the further information referred to in article 15 (1) and (2) DSGVO.
b) You have the right to have incorrect personal data relating to you immediately corrected. Taking into account the purposes of processing, you also have the right to demand the completion of incomplete personal data, including by means of a supplementary declaration.
c) You may require us to immediately delete the personal data relating to you under the conditions laid down in article 17 (1 DSGVO), insofar as the processing is not necessary in accordance with article 17 (3 DSGVO).
d) You may require us to restrict the processing of your data if one of the conditions laid down in article 18 (1) is DSGVO. In particular, you can request the restriction instead of deletion.
E) We will notify any correction or deletion of your personal data and a limitation of processing to all recipients to whom we have disclosed personal data relating to you, unless this proves to be impossible or is Disproportionate effort. We will also inform you of these recipients if you so request.
f) You have the right to receive the personal data you have provided us in a structured, common and machine-readable format, and may require that we transmit this data to another person responsible without hindrance, as far as Technically possible.
