DaWanda GmbH, Windscheidstr. 18, 10627 Berlin is the operator of the DaWanda website and of the mobile apps, as well as the processor within the meaning of data protection law (referred to hereinbelow as “we”).  Please feel free to contact us under info@dawanda.com and our Data Protection Officer under dataprotection@dawanda.com .

Below is an overview of how we collect and process your data pursuant to the General Data Protection Regulation (GDPR) and the Bundesdatenschutzgesetz (BDSG, Federal Data Protection Act).

  1. Data collected automatically when you visit the website

We automatically collect the data that your browser regularly transmits to our web server when you use the Internet, e.g. your IP address, the URLs of the websites from which you navigated to our websites, the browser used, the browser language, the operating system used and interface, the access device with which the services are used, date and time of access, the pages of our websites you call up and the time you spend on our websites. The data are stored for a period of twelve  (12) months and will be automatically deleted thereafter.

  1. Data you provide to us / member accounts / data processing for transactions

In order to enable us to provide you with our services, we will need to have a range of different data about you:

When you register, we will collect your master data (member name, first name and last name, email address, password).  By selecting a member name, you will be able to use our internet platform such that other users, i.e. third parties, will see only your pseudonym.  If you decide to place an order using DaWanda, we will also collect the billing address and the delivery address as well as payment data. If you wish to sell products using DaWanda, we furthermore will collect your full address, the name of your shop and of your company, your status as a seller (commercial trader or private individual) as well as your bank account information and other payment information.

In order to protect our legitimate interests, we may obtain a credit report (e.g. in Germany from SCHUFA Holding AG in Wiesbaden) about you and/or will have a credit card company verify personal data concerning you. We also reserve the right to ask you for a bank reference or a guarantee, or that you lodge credit card details as well as a security deposit using a credit card before we allow you to offer or acquire highly priced goods or services on DaWanda.  Your interests meriting protection will be taken into account in accordance with the provisions of the law.

As concerns the individual offerings available on DaWanda, we will collect the respective usagee data and transaction data.  This includes in particular the purchase and sale of products by buyers and sellers and the acquisition of marketing services by sellers.  The transaction data comprise the respective acquisition process (what was bought, parties involved, payment and billing data).

Moreover, registered members have the opportunity to voluntarily provide optional data (e.g. a description of their shop, “About me” profile details, personal interests or preferences, photos (e.g. profile picture), date of birth and other biographical data, settings for notifications or newsletters, recommended or bookmarked products, messages, guestbook or blog posts, contributions in forums, ratings, comments, responses to surveys, private messages to other members, etc.).  As a seller, you will have the opportunity, for example, to provide your General Terms and Conditions (which may also include information on the right of withdrawal etc.), your own privacy policy and website information as well as the goods and services you are offering. Please note that any data you additionally provide in your profile under the heading “About me” will also be visible to other members and visitors.  As an example, you can also tie in an RSS feed or show your Facebook feed. You may at any time modify or remove the information you have provided voluntarily. Any information you provide in order to advertise the goods or services you are offering will be visible as a matter of course to all other members and visitors of the site.

We will retain your master data and the data connected to your member account for as long as you maintain your member account with us.  Should you decide to cancel your member account, the data will be archived over a period of two (2) years in blocked form. Notwithstanding this fact, we will store transaction data (i.e. data purchase processes or sales processes) for a period of three (3) years and thereafter will retain the information required under commercial law and tax law for the periods stipulated by law (as a general rule, for a period of ten (10) years following the conclusion of contract).  Transaction data that we have disclosed to a seller in the context of a purchase will continue to be stored in the seller’s member account for the above-cited periods of time.

Information that you publish yourself, such as posts you make in forums, ratings you award, and comments, will continue to be retained even if your member account is deleted in order to ensure that the discussions in particular may be read and understood.  However, we will replace your user name (i.e. the pseudonym you have selected) by the indication “Deleted Member” and will delete your profile picture. Private messages you have sent to other members will continue to be stored in the recipient’s member account even if you have deleted your own member account.

Should you contact us or our Customer Support (e.g. via email, via telephone or using a contact form via the website) or our feedback tools, we will use the data you provide (as a general rule, your contact data and your inquiry) in order to react to your inquiry. Inasmuch as they concern business correspondence within the meaning of commercial law or tax law, we will store the correspondence for the periods of time stipulated by the law (as a general rule, six (6) or ten (10) years).

  1. Registration via Facebook Connect

Facebook users have the opportunity to log on to our site using “Facebook Connect.”  In that event, you do not have to register a user account of your own with us; all you need is your Facebook login information.  For that purpose, certain personal data will be transferred from Facebook to us. Facebook will inform you in the course of the registration process which of your data are to be transferred (“Facebook Data”); you will have the opportunity to expressly consent to such transfer or to refuse such consent.  Without your consent, no personal data will be transferred from Facebook to us. If you do grant such consent, we will be able to see your user name and your public profile on Facebook. These data will then be integrated into your member account. The use of these data will serve exclusively the purposes set out above in the present Privacy Policy.  Conversely, Facebook will be able to see, as a consequence of your logging on to our site using Facebook Connect, that you have logged in and when you have done so.

You have the opportunity at any time to cease using Facebook Connect and to create your own member account with us, for example.

  1. Newsletter and marketing-emails

Inasmuch as you consent to receiving marketing emails and/or newsletters (for example when you register), you declare that you agree to receive at regular intervals (up to seven times a week) emails with content that we select for you under the email address you have provided.  These emails will refer to products and services typically offered by sellers using DaWanda platforms and may additionally include advertisement from DaWanda members or third party providers.

You may easily revoke your consent to receiving these types of emails at any time and free of charge, for example by clicking on the “unsubscribe” link in our emails.

By revoking your consent or by unsubscribing, your contact details will be deleted unless they will continue to be stored as part of your member account or in the context of purchases / sales.

  1. Use of cookies, web beacons and similar processes

Like nearly all other providers of services, we use cookies, web beacons or similar processes when you visit our websites or use our offerings.

Cookies are small text files that are placed on your computer or your mobile end device by your browser, which allow your computer or end device to be recognized, under certain circumstances across different websites.  Cookies do not contain personal data. Some of the cookies we use will be deleted at the end of your browser session, in other words, when you close your browser (so-called “session cookies”). Other cookies will be stored on your end device, thus allowing us or our partner companies to recognize your browser when you next visit our or their website (persistent cookies).

  1. Conversion tracking

We avail ourselves of the services provided by third-party advertisement partners in order to advertise our offerings using advertisement means placed on external websites.  In the process, we also use marketing tools in order to establish how successful the individual advertisement measures are (“conversion tracking”). We do so in order to display ads that are of interest to you, in order to make our website more interesting for you, and in order to ensure that the costs we are charged for our advertising are fair.

To this end, our advertisement partners use cookies and web beacons (see above), by which certain parameters serving to measure success such as the display of the ads or the clicks by users can be measured.  These cookies are not intended to serve to identify you personally. For as long as the cookie is valid, the advertisement partner will be able to recognize that you have clicked on an ad and that you have navigated to a certain target page (e.g. a form to be completed, a product page or a registration page for a newsletter).  The advertisement partner will use the cookie to compile conversion statistics.   1. Advertisement on our website

We avail ourselves of online advertisement services in order to allow advertisement to be shown on our website that is tailored to your interests. In so doing, we are pursuing our interest in displaying advertisement that might be of interest to you, in order to make our website more interesting for you.  To this end, statistical data will be captured about you, which will be processed by our advertising partners.

The online advertisement services use cookies in order to display ads that are of relevance to users, to improve the reporting on campaign services, or in order to avoid showing one and the same ad to the same user in several instances.  Using cookies, the online advertisement services will see which ads are being displayed in which browser and will be able to avoid these ads being shown several times. The DaWanda app provides another means of access to the DaWanda platform.  Accordingly, we use your data within the app as if you were accessing DaWanda via our website.  This applies, for example, also to the use of your data, cookies, plug-ins or Google Analytics, which will be used for the same purposes on the same legal basis.  Thus, the statements made in the present Privacy Policy will apply mutatis mutandis to the app.

 

 

When you use the app, DaWanda may additionally access further data relating to your app or your end device, e.g. the name of the device, its manufacturer, model, operating system number, app number or SDK version and the device number (IMEI).  These data will be used for the purposes set out below under c). We will not access your data located outside of the app, such as your calendar, photos, messages or such like unless you have permitted us to do so.

The DaWanda app may use your locational data in anonymized, respectively pseudonymized, form if you have allowed access to these data on your device.  We would like to use the locational data in order to give you a better DaWanda experience or to show articles, offers, campaigns or advertising to you that might be of interest to you, or to notify you of them.  Personal data such as names, addresses or dates of birth will not be collected, stored or transmitted. Likewise, the capture of complete IP addresses is ruled out.

 

 

We use analytics services in order to compile pseudonymized statistics and analyses on the use of the app and the DaWanda services.  To this end, we use in particular the respective IP address and the device identifier of your device. We may also use this information in order to create pseudonymized usage profiles across the devices used (“cross-device tracking”).  The statistics themselves will not include data that could be used to identify you. You may deactivate these analysis functions at any time by correspondingly changing the settings of the DaWanda app.

Push notifications

If you have correspondingly configured your mobile end device and have activated push notifications in the DaWanda app, this will enable the DaWanda app to send push notifications to your device, for example in order to provide you with information about us, about products (e.g. DaWanda Inspirations & Highlights), campaigns, news or new functionalities or to send you system notifications.

You may easily revoke your consent to receiving push notifications at any time and free of charge, for example by unsubscribing from push notifications in the app or by deactivating them in the settings of the operating system.

 

  1. Data recipients

 

 

We share personal data with the contractual partner in the context of a purchase for purposes of settling the purchase (e.g. contact information, postal address, payment information and payment details).  This comprises data that are necessary in order to settle the purchase, including the data necessary in order to promote the reliability and security of the transaction.

You may also disclose personal data yourself by using the corresponding communications functions DaWanda makes available (e.g. direct messages to other members, entries in the guest book or in a blog, contributions in forums, ratings, comments, and responses to surveys).

Data of other members may permissibly be used exclusively for communications purposes regarding DaWanda where necessary (e.g. in order to settle a purchase or to deal with any complaints).  In particular, you must not use the data of other members for advertising purposes unless the member concerned has expressly agreed to this being done. Moreover, members are under obligation to comply with all requirements under the laws governing data protection.

Inasmuch as a member makes available his or her personal data to another member, we will not be in a position to warrant the continued protection of such data.  As a consequence, we kindly ask that you satisfy yourself as to whether or not the other member merits your trust and in fact truly needs the data before you share your data with that other member.

 

 

We may share your sales information (e.g. names of your shop, data, images, and stars for the products offered) with third parties (e.g. affiliate networks, affiliate partners, platforms) to allow your offers to be advertised and presented to potential purchasers there.  

You may discontinue the use of your sales information at any time in “My DaWanda” under the menu items “My DaWanda - Products and Shop - Edit my Shop - Sharing your products on partner sites.”

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you concerning you which is based on Article 6 paragraph 1 letter f of the GDPR (Article 21 paragraph 1 of the GDPR).

Where we are processing personal data concerning you pursuant to Article 6 paragraph 1 letter f of the GDPR for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you without needing to state the reason (Article 21 paragraph 2 of the GDPR).
